1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of StudyNest, a product built and operated by Afif Innovation. By creating an account or using any part of StudyNest, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not access or use the service.

2. About StudyNest

StudyNest is an educational platform that helps students, parents, and families organise study plans, track syllabus progress, manage exam schedules, and analyse academic results. The platform is developed and maintained by Afif Innovation.

3. Beta Program

By participating in the beta program, you acknowledge and accept the following:

• No charge: The beta is completely free. No payment information is required or collected.
• No commitment to retain data: Afif Innovation is not obligated to preserve, migrate, or continue hosting your data after the beta period ends. You are responsible for exporting any data you wish to keep before the beta concludes.
• No commitment to continue the service: Afif Innovation does not guarantee continued availability of StudyNest in its current form, or at the same price, after the beta period ends.
• Product may change: Features, interfaces, and functionality may be added, modified, or removed without prior notice during the beta period.
• Service interruptions: The beta service may experience downtime, data loss, or other issues inherent to early-stage software. We appreciate your patience and feedback.

4. Eligibility

To use StudyNest, you must be at least 13 years of age. Users between the ages of 13 and 18 should have the consent of a parent or legal guardian. By creating an account, you represent that you meet these requirements.

5. Your Account

You are responsible for:

• Keeping your login credentials (email, password) confidential and secure.
• All activity that occurs under your account, whether or not you authorised it.
• Providing accurate, current, and complete information during registration.
• Notifying us immediately if you suspect unauthorised access to your account.

You may not create accounts on behalf of another person without their explicit permission, or create accounts for automated or non-human purposes.

6. Acceptable Use

You agree not to:

• Use StudyNest for any unlawful, harmful, or fraudulent purpose.
• Attempt to gain unauthorised access to any part of the service, its servers, or its databases.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of StudyNest.
• Upload or transmit malware, viruses, spam, or any content that may damage or interfere with the service.
• Scrape, copy, or redistribute any content or data from StudyNest without express written permission.
• Impersonate any person, entity, or Afif Innovation employee.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Data and Privacy

Your use of StudyNest is subject to our Privacy Policy, which explains what data we collect, how we use it, and your rights. Key points relevant to these Terms:

• Afif Innovation maintains data security standards to protect your information.
• We do not access or review your personal data without your explicit consent, except where required by law.
• After the beta period, Afif Innovation is not committed to retaining your data. Please export your information before the beta concludes.

8. Intellectual Property

All content, design, branding, code, and other materials within StudyNest and the Afif Innovation website are the intellectual property of Afif Innovation unless otherwise noted. You are granted a limited, non-exclusive, non-transferable licence to use StudyNest for personal, non-commercial purposes only.

Content you create within StudyNest (study plans, notes, results) remains your own. By storing it on the platform, you grant Afif Innovation the technical right to host and display it as necessary to operate the service.

9. Disclaimers

StudyNest is provided "as is" and "as available" during the beta period. Afif Innovation makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted operation.

We do not warrant that the service will be error-free, that defects will be corrected, or that the platform or its servers are free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Afif Innovation and its team members shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or interruption of service — arising out of or in connection with your use of, or inability to use, StudyNest.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to Afif Innovation in the 12 months preceding the claim (which, during the free beta, is zero).

11. Modifications to Terms

We may update these Terms at any time. We will provide reasonable notice of material changes through in-app notifications or email. Your continued use of StudyNest after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by applicable laws without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation between the parties.
